​What is Subrogation?


Subrogation is when one party takes on the legal rights of another party whose expenses have been paid. Imagine that an insurance company has paid on a claim for an individual under the terms of their insurance agreement. But the cause for the original claim – a car accident, a slip and fall due to negligence, or something similar – was due to another party. The insurance company can now seek reimbursement from that third party originally responsible for the event to recover the money they paid to the insured.

In this same scenario, if the individual who made the claim proceeds with a lawsuit against the negligent third party, then any money received should go to the insurer. Otherwise, the individual would have effectively received two payouts for one event, which is known as double recovery (one payout from the insurer who covered the event and one payout from the responsible party who paid the settlement or judgment in the lawsuit).

This is a very simplified explanation of subrogation as the underlying law is significantly more complex. However, these are the basics you need to understand if you are an insurer, employer, or individual with subrogation issues.

What Is Alternative Dispute Resolution?


Alternative Dispute Resolution (ADR) is a method of resolving disagreements between parties outside the courtroom. Techniques used in ADR include:

Negotiation, in which two or more parties enter discussions with the intent of reaching a mutual agreement.
Mediation, in which a third party facilitates discussions between the parties until they reach a mutual agreement.
Arbitration, in which the parties agree to abide by the decision of an arbitrator.

Sometimes parties, who cannot resolve a conflict, choose Alternative Dispute Resolution. Other times, they are ordered by the Court or pursuant to the terms of a mediation/arbitration agreement.
